Terms of Service

These terms govern your use of PestDesk. By creating an account or using the service, you agree to them. Please read section 6 in particular — it concerns your regulatory obligations, which PestDesk helps you document but does not discharge.
1. The service
PestDesk is web-based software for pest control businesses, covering customers and properties, job scheduling, pesticide application records, invoicing, inventory and route planning, together with optional retrieval of your Google Local Services Ads leads. We provide it on a subscription basis at app.pestdesk.app.
We may add, change or remove features. Where a change materially reduces functionality you rely on, we will give you reasonable notice.
2. Your account
- You must provide accurate registration details and keep your login credentials secure.
- You are responsible for everything done through your account.
- You must be operating a business and be legally able to enter into this agreement.
- Tell us promptly if you believe your account has been compromised.
3. Subscriptions and payment
Plans and prices are shown on our website. Subscriptions are billed for the plan you select. New accounts begin with a free trial period; no payment is required to evaluate the service.
You can stop using PestDesk at any time. Fees already paid for a current period are not refundable except where required by law. We may change prices with at least 30 days' notice.
4. Your data
You retain ownership of everything you put into PestDesk, and of the lead data we retrieve on your behalf. You grant us only the permission needed to host, process and display it in order to provide the service.
Our handling of that data is described in our Privacy Policy. You can export your records from the app, and you can ask us to delete your workspace at any time.
5. Google account connection
Connecting a Google account is optional. If you connect one, you confirm you are authorised to access that Google Ads or Local Services account. PestDesk will read leads and send replies you compose; it will not alter your campaigns, budgets or account settings.
Your use of Google's services remains subject to Google's own terms. Google controls what its API makes available, and may change or restrict it; we are not responsible for lead data that Google does not return, removes, or delays. Lead charges, credits and disputes are between you and Google.
You can revoke our access at any time from within PestDesk or from your Google account permissions.
6. Regulatory records remain your responsibility
PestDesk helps you record and print pesticide application information, including PCP registration numbers. It is a record-keeping tool, not a compliance authority. You remain solely responsible for holding the correct licences, for applying products lawfully and according to their labels, and for the accuracy and retention of the records you are required to keep. We do not warrant that any record produced by PestDesk satisfies any particular regulator.
7. Acceptable use
You agree not to:
- use PestDesk to send unsolicited messages, or to contact people who have asked you not to;
- upload unlawful content, malware, or anyone else's data that you have no right to hold;
- attempt to access another company's workspace, or probe, scan or disrupt the service;
- resell or white-label the service without our written agreement;
- use the service in breach of applicable law, or of Google's policies where the Google connection is used.
We may suspend an account that breaches this section.
8. Availability
We aim to keep PestDesk available and reliable, but we do not guarantee uninterrupted service. The service depends on third-party infrastructure, and maintenance or outages may occur. Some features require an internet connection; others work offline and synchronise when you reconnect.
9. Disclaimers
Except as expressly stated in these terms and as required by applicable consumer law, PestDesk is provided "as is" and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that it will meet every requirement of your business.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, lost business or lost data. Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Termination
You may stop using PestDesk and close your account at any time. We may suspend or terminate your account for a material breach of these terms, or if required by law, giving notice where it is reasonable to do so. On termination you may export your data for 30 days, after which we may delete it.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, and the courts of Ontario have exclusive jurisdiction, without affecting any right you have to bring a claim in your own place of residence where the law gives you that right.
13. Changes to these terms
We may update these terms. The date at the top reflects the current version, and we will give notice in the app or by email before a material change takes effect. Continuing to use PestDesk after that means you accept the updated terms.
